Washington Law – Reusable Tenant Screening Report (RTSR)
Washington State law (Revised Code of Washington 59.18.257) allows for prospective tenants of residential properties to provide their own Reusable Tenant Screening Report (RTSR) to landlords, also sometimes referred to as a Portable Tenant Screening Report (PTSR). The report includes identity verification, credit report, criminal history, eviction history, employment and verification, and address and rental history as well as certification that the information has not materially changed. The state law does not mandate landlords to accept a full and accurate Portable Tenant Screening Report. However if they do accept your Portable Tenant Screening Report (PTSR), they cannot charge the you for an additional screening report.
What’s in a Reusable Tenant Screening Report?
A comprehensive RTSR must include:
- Credit history
- Rental history and any past evictions from the last seven years
- Criminal background check, including a check of sex offender registries
- Employment and income verification
- Proof of current address
Your Rights as a Tenant
- Right to obtain a report: You have the right to obtain your own report.
- Portability: The report is portable and can be used with multiple landlords for up to 30 days.
- Right to dispute information: You have the right to dispute any inaccurate information on the report.
- Adverse Action Notice: If a landlord denies your application based on the report, they must provide you with an Adverse Action Notice explaining the decision and giving you the right to dispute the information.
Landlord Requirements
- Written Acceptance: If a landlord accepts reusable reports, they must state this in writing and specify their screening criteria.
- Reviewing the Report: Landlords cannot charge a tenant to review their reusable tenant screening report.
- Adverse Action: If a landlord denies an application based on the report, they must issue an Adverse Action Notice.
